Terms and Conditions of Sale
Article 1 - Purpose
These Terms and Conditions of Sale (T&C) govern the contractual relationship between Creative and Cool (SAS with share capital of 10 000 euros, SIRET 981 085 624 00022, RCS Angers 981 085 624, with registered office at 7 Rue des Oujardes, 49190 Rochefort-sur-Loire), hereinafter "the Seller", and any person making a purchase on the creative-and-cool.com website, hereinafter "the Customer".
Any order placed on the website implies unreserved acceptance by the Customer of these T&C.
Article 2 - Products
The products offered for sale are those appearing on the site on the day the Customer consults it. Product photographs are as accurate as possible but are not contractually binding on the Seller. The Seller reserves the right to modify the product range at any time.
Article 3 - Prices
Prices are indicated in euros, including all taxes (VAT included) for private individuals, and excluding taxes for businesses. The applicable VAT is the one in force on the date of the order. Delivery costs are indicated before the order is validated.
The Seller reserves the right to modify its prices at any time; however, products will be invoiced on the basis of the prices in force at the time the order is recorded.
Article 4 - Ordering
The Customer places their order online by following this process: selecting items, adding to cart, validating the cart, identification, choosing a delivery method, choosing a payment method, final validation.
Validation of the order constitutes acceptance of these T&C. An order confirmation is sent to the Customer by email.
Article 5 - Payment
Payment is made online by bank card (via Stripe) or PayPal. Transactions are secured. The order is considered effective after confirmation of the agreement of the banking payment centres.
In the event of default of payment, the Seller reserves the right to suspend or cancel the order.
Article 6 - Delivery
Products are delivered to the delivery address indicated by the Customer when placing the order, within the timeframes announced on the site. Several delivery methods are offered (Mondial Relay, Chronopost, etc.) with their respective timeframes and rates.
In the event of a delivery delay exceeding 7 days from the originally scheduled date, the Customer may request cancellation of the order and obtain a full refund.
The Seller cannot be held responsible for the consequences of a force majeure event (strike, natural disaster, etc.).
Article 7 - Right of withdrawal
In accordance with article L.221-18 of the French Consumer Code, the individual Customer has a period of 14 calendar days from the receipt of the product to withdraw without having to justify any reason or pay any penalties.
To exercise this right, the Customer must notify their decision by email to hello@creative-and-cool.com or by any other written means. Products must be returned in their original condition, complete and unused.
Return costs are borne by the Customer. The refund is made within a maximum period of 14 days after receipt of the returned product.
Article 8 - Warranties
All products benefit from the legal warranty of conformity (articles L.217-4 et seq. of the French Consumer Code) and the warranty against hidden defects (articles 1641 et seq. of the French Civil Code).
In the event of a non-conforming or defective product, the Customer may contact the Seller at hello@creative-and-cool.com to obtain a replacement or refund.
Article 9 - Liability
The Seller's liability cannot be engaged for indirect damages suffered by the Customer due to the use of products ordered on the site.
Article 10 - Personal data
The information collected is processed in accordance with the GDPR and detailed in our Privacy Policy.
Article 11 - Mediation and dispute resolution
In the event of a dispute, the Customer may use a consumer mediator. In accordance with article L.612-1 of the French Consumer Code, the Customer may freely refer the matter to a mediator whose contact details will be communicated on request to hello@creative-and-cool.com.
The Customer may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr.
Article 12 - Governing law
These T&C are subject to French law. In the event of a dispute, French courts shall have sole jurisdiction.
